Terms of Use for ClassMana

Introduction

Welcome to ClassMana, an educational platform designed to enhance classroom engagement. By accessing or using ClassMana, you agree to comply with and be bound by the following terms and conditions.

Operator

ClassMana is operated by Dewitters BV, a company registered in Belgium. Throughout these Terms of Use, references to "ClassMana", "we", "us" or "our" refer to Dewitters BV. You can contact us at info@classmana.com.

Eligibility

ClassMana is available for use by teachers, students and any other person. Account holders must be at least 18 years of age to create an account.

Account Requirements

• Teacher Accounts: Teachers are required to provide an email address and create a password to register and access their accounts.
• Student Access: Students use unique tokens provided by their teachers to access ClassMana. Students' full names are shortened to the first name and, if necessary, the first letter of their last name to ensure uniqueness within a classroom.

Communication

By registering for ClassMana, you agree to receive email communications, including:

1. Account-related communications, such as password recovery emails.
2. Our newsletter, which may include updates, news, and promotional content related to ClassMana.

You can unsubscribe from the newsletter at any time by following the unsubscribe link in the email.

User Responsibilities

• Users agree not to share any personal information that could compromise their privacy or the privacy of others.
• Teachers are responsible for managing student tokens and ensuring that access is given only to authorized students.
• Users must comply with all applicable laws and regulations while using ClassMana and are responsible for maintaining the confidentiality of their account credentials.

Education Data and School Contracts

When ClassMana is used by or on behalf of a school, district, or other educational agency, student records remain under the control of the teacher, school, district, or educational agency that provides or creates them. ClassMana processes student data only as needed to provide, secure, support, and improve the educational service, comply with law, and meet the applicable written agreement.

Content Ownership

Users retain all rights to the content they create and share on ClassMana. By using the platform, users grant ClassMana a limited, non-exclusive license to host, process, display, transmit, and otherwise use that content only as needed to provide, secure, support, and improve the service, comply with law, and as otherwise authorized by the user or an applicable written agreement. ClassMana does not sell student personally identifiable information or use student data for advertising, profiling, marketing, or unrelated commercial purposes. If ClassMana publicly showcases examples of platform use, we will use anonymized or non-student content, or obtain appropriate permission before using identifiable content.

Prohibited Activities

Users are prohibited from:

• Engaging in any illegal activities or using ClassMana for any unlawful purpose.
• Harassing, threatening, or abusing other users of the platform.
• Attempting to reverse-engineer, decompile, or otherwise tamper with the platform.
• Collecting or harvesting data from other users without their explicit consent.

Termination Policy

ClassMana reserves the right to suspend or terminate user accounts at any time if there is a violation of these terms. Users may also terminate their account at any time by deleting it from the Account tab of their profile, or by contacting us at info@classmana.com. Deleting your account permanently removes all data you own (classes, students, rewards, powers, quests, activity history, and related records) and cannot be undone. If you are the admin of an active paid license, or the sole admin of a license that still has other members, you must cancel the subscription or transfer admin rights before deleting your account.

Payment Terms

ClassMana offers a premium version with additional features. Subscription fees and payment terms will be provided at the time of purchase. Payments are processed by our authorised reseller, Paddle.com Market Limited, which acts as the merchant of record for all purchases.

Refund Policy

You may request a full refund of any purchase within 30 days of the transaction date. To request a refund, contact us at info@classmana.com or use the refund request link in your purchase receipt from Paddle.

Where local consumer protection laws grant you greater rights (for example, a longer statutory withdrawal period), those rights apply in addition to the 30-day window above. The full refund process and country-specific rules are described in Paddle's Refund Policy and Paddle's Buyer Terms, which apply to all transactions.

Liability and Warranties

ClassMana is provided "as is" and without any warranties, whether express or implied. We do not guarantee that the platform will be uninterrupted, error-free, or suitable for any particular purpose. To the fullest extent permitted by law, ClassMana and its affiliates are not liable for any damages arising from the use of the platform.

Third-Party Services

ClassMana uses third-party services for analytics, email communication, and hosting to deliver our platform. We ensure that these providers comply with relevant privacy regulations. For more details on how these services handle your data, please refer to our Privacy Policy.

Modifications to the Terms
